Holyoke Child Porn Defendant Stuck In Legal Limbo

Edward Dupont (74), from Holyoke, who was charged with possessing child pornography, is stuck in a legal limbo. Dupont, with at least 135 other defendants, was charged in the Playpen case after the FBI obtained a warrant from a magistrate judge in Virginia to take over the website, which contained thousands of child porn images and videos.

Operation Pacifier, the law enforcement action that resulted in the arrest of several persons including Dupont, took place in 2015. However, when U.S. District Judge William Young released a 39-page order in May claiming that the search warrant used in the operation was illegal, it was a game-changer for defendants, prosecutors and defense attorneys everywhere. With all the electronic evidence extracted from the search warrant suppressed against Alex Levin (49), a computer technician charged with the possession of child pornography material, prosecutors found themselves with “virtually no case.” The government appealed Young’s decision to a higher court for review.

In Dupont’s case, an FBI affidavit charging him with possessing child porn states that during the house search of the 74-year-old man, agents found more than 16,000 images on his computer and several videos showing the rape of a girl as young as 5 and a 170-page manual titled “How to practice child love.”

Dupont has been denied pretrial bail since September, however, Kevin Murphy from Dupont’s defense intends to file a new motion for the man’s pretrial release.

Victor Stepus (47), from Chicopee, who has been arrested during Operation Pacifier too, has also been fighting for pretrial release in the wake of the Levin decision. His lawyer, Alan J. Black, predicts the case may be appealed up to the U.S. Supreme Court and could potentially wipe out many of the associated prosecutions.

  2. The sad reality is that the dope will likely die in prison. Some other Pedos who got apprehended during this bust have gotten out of jail; why not grandpa?

    Just goes to show everyone that anonymous public Wi-Fi with Tails and full back-end encryption is an absolute must!!

    • Yeah, and if “grandpa” had pleaded the 5th, kept his mouth shut, or, better yet, had, as you state, used good OpSec, he would not be in jail and estranged from his wife and family. Rather, he’d be like the other 249K Playpen users whom the Feds were not able to track down.

    • The pedos that are too weird to be around kids in real life have to download it. The pedos that are around kids in real life get arrested for touching. Grandpa getting arrested and staying in jail or an 18 year old getting arrested and posting bail really doesn’t matter to people, they’re just happy these people are getting arrested because they carry that arrest record around for life. 10 years ago you’d read about it in the news maybe twice a month. Now its a few times a week, and because of that more kids are coming out to tell on their abusers. There’s never been a good time to be a kid diddler, but this is definitely the worst time in recent history for someone to be one because of how many are getting caught, and that makes me happy. :)

        pretty much…..except its much harder to convict real-life pedos who touch up kids because there is a much higher standard of proof than CP …. witnesses can be cross-examined and, unless there is some sort of forensic evidence, its hard to get a conviction…and, even if convicted, it can be appealed all the way up to the highest court in the land, if necessary…..

        how-ever…with CP….all they gotta do is say that they ‘found’ it on yr HDDs or SSD or thumb-drive or wht-ever…after they’ve had yr desk-top/lap-top/android for a good few days, of course ;)

        not necessarily saying its the case here, but its a convenient and easy was for TPTB to effectively bury some-one they don’t like with a minimum of effort….
        actually…i’m a bit surprised that they hvn’t ‘tried it on’ with Trump yet…or some of his close associates….in order to de-rail his campaign….

      • No evidence exists that decreases in child sexual abuse are due to increased reporting, better law enforcement or increased imprisonment. In fact, all the evidence points to the fact that sexual predators are “hard wired” to be who they are, and so, the decrease in child sexual abuse is likely due to the increased availability of CP in the Deep Web and Internet, in general.
